Welcome to the Any Shot Media website. By accessing our website, requesting a quote, or engaging our video production services, you agree to be bound by these Terms and Conditions. Please read them carefully.

These Terms and Conditions constitute a legally binding agreement between Any Shot Media (ABN: [Insert ABN if known, otherwise placeholder]) ("we," "us," or "our") and the Client ("you" or "your").

1. Scope of Services

Any Shot Media provides professional video production services, including but not limited to brand videos, corporate interviews, event videography, drone operations, and post-production editing (the "Services").

Quotes & Estimates: All quotes provided are valid for 30 days from the date of issue. Quotes are based on the information provided by the Client at the time of inquiry. We reserve the right to amend the quote if the project scope changes (e.g., additional filming days, extra edits, or location changes).

Bookings: A booking is only confirmed once a deposit (if applicable) has been paid or a formal agreement/booking form has been signed.

2. Payment Terms

Deposit: For projects exceeding $1,000 AUD, we require a 50% non-refundable deposit to secure the filming dates and pre-production resources.

Balance: The remaining 50% balance is due upon delivery of the first draft or within 14 days of the shoot completion, whichever occurs first, unless otherwise agreed in writing.

Final Delivery: Final high-resolution files (without watermarks) will only be released once full payment has been received.

Late Payments: Invoices not paid within the specified terms may incur a late fee of 5% per month or part thereof, plus any debt collection costs incurred.

3. Cancellations and Rescheduling

We understand that plans change. However, late cancellations result in lost income and unrecoverable costs for our crew.

Client Cancellation:

More than 7 days notice: No cancellation fee applies (Deposit may be transferred to a future date).

48 hours to 7 days notice: 25% of the total project fee is payable.

Less than 48 hours notice: 50% of the total project fee is payable.

Weather: For outdoor or drone shoots, safety is our priority. If weather prevents filming (rain, high winds, or low visibility), we will reschedule the shoot to the next available date at no extra cost. This decision is at the sole discretion of the Any Shot Media lead creative or pilot.

4. Intellectual Property & Copyright

Ownership: Upon full payment of the final invoice, Any Shot Media grants the Client a perpetual, non-exclusive, worldwide license to use the Final Video Product for the agreed purposes (e.g., website, social media, internal training).

Raw Footage: Unless explicitly stated in the quote as a line item, Any Shot Media retains ownership of all raw footage, project files, and unedited assets. Raw footage can be purchased for an additional fee.

Moral Rights: Any Shot Media retains the right to use the finished work for our own portfolio, marketing, and social media promotion, unless a Non-Disclosure Agreement (NDA) has been signed preventing this.

Music Licensing: We license music for your project based on the intended use (e.g., Web & Social). If you require broadcast rights (TV/Cinema) or paid advertising rights, additional licensing fees may apply.

5. Client Responsibilities

Approvals: The Client is responsible for obtaining all necessary permissions, permits, and release forms for locations, people, and copyrighted materials (e.g., logos, artwork) visible in the video, unless Any Shot Media has been specifically contracted to manage this.

Review Process: Our standard packages include two (2) rounds of revisions. Revisions must be requested within 14 days of receiving the draft. Further revisions or changes to the original brief will be charged at our standard hourly editing rate.

Feedback: Feedback must be consolidated (one list of changes) to ensure efficiency.

6. Liability and Indemnity

Australian Consumer Law: Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value.

Limitation of Liability: To the maximum extent permitted by law, Any Shot Media is not liable for any indirect, incidental, special, or consequential loss (including loss of revenue, data, or opportunity) arising from the use of our services. Our total liability is limited to the value of the fees paid by the Client for the specific project.

Indemnity: You agree to indemnify Any Shot Media against any claims, costs, or damages arising from materials you provide to us (e.g., photos, scripts, logos) that infringe on the intellectual property or privacy rights of a third party.

7. Drone Operations (CASA Compliance)

Safety First: All drone operations are conducted in strict accordance with the Civil Aviation Safety Authority (CASA) regulations. The Remote Pilot in Command has final authority to cancel a flight if safety is compromised (e.g., proximity to people, weather, airspace restrictions).

No Pressure: The Client must not pressure the pilot to fly in unsafe or illegal conditions. If a flight is cancelled for safety reasons, no refund is due for that portion of the shoot if the hazard was outside our control.

8. General

Governing Law: These Terms constitute the entire agreement between the parties and are governed by the laws of New South Wales, Australia.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Amendments: We reserve the right to update these Terms at any time. The Terms applicable to your project are those available on our website at the time of booking.
